Temporary Employer Sponsorship Visas & Visas for Skilled Workers 

There are a number of different temporary employer sponsorship visas available in Australia, each with its own specific requirements and conditions. However, all of these visas require the sponsorship of an eligible employer. A temporary skilled work visa in Australia can be used to fill critical skills shortages in the country or to allow businesses to bring in highly skilled workers from overseas.

Temporary Skill Shortage Visa – Subclass 482

Businesses in Australia are able to designate foreign workers to fill skill gaps in their operations through a Temporary Skill Shortage Visa. The suggested occupation must be one of those listed on the Temporary Skill Shortage List (TSS) of professions. This may appear on the Short-term Skilled Occupation List (STSOL) or the Medium and Long-term Strategic List (MLTSSL). Note: this is not a permanent visa.

Short-Term Stream Criteria

• • Workers seeking to fill positions registered under the STSOL can be granted a visa of up to 2 years. If you are in Australia nearing the end of your 2 years, you may apply for a further 2 years only once.

• This employer-sponsored visa does not give the person holding it the option to apply for Permanent Residency in Australia – unless special exemptions apply (according to the concessions provided by most recent release of the legislative instrument LIN 22/038).

• Periods of up to four years are available to occupations listed on the STSOL when requested by the sponsor and the visa holder is from a country with which Australia has an international trade obligation. These countries include Canada, China, South Korea, Japan, New Zealand, Chile, Mexico, Singapore and Vietnam.

Medium-Term Stream Criteria

• Occupations listed under the MLTSSL are eligible to be granted a visa of up to 4 years, which can be renewed prior to expiration. 
• Hong Kong passport holders are eligible for up to a 5-year stay.
• Sponsored visas in which visa applicants are nominated under the MLTSSL occupations in for the TSS 482 visa, allows visa holders to apply for a Permanent Residence Visa (subclass 186) after 3 years as long as:
  
  • They are still employed by the same Australian employer sponsor and,
  • They hold a 482 visa in the same occupation over a 3-year period of time. 

How this visa works:

Step 1: Sponsorship

• The employer looking to bring the applicant to Australia needs to apply for approval as a Standard Business Sponsor by presenting documentation demonstrating they run a business. This information can be presented with documents such as:
  
  • Financial statements
  • Marketing materials
  • Company registration documents
  • Organisational chart and
  • Other required information
• Once approved, Business Sponsorship is valid for 5 years. During this time, the sponsoring business is able to nominate any number of people it would like to sponsor as long as this is to meet a genuine business need.
• Businesses that sponsor overseas employees have obligations that need to be fulfilled and are monitored by the Department of Home Affairs.

Step 2: Nomination

• The position the company needs to be filled must be selected from either the STSOL or MLTSSL to be considered.
  
  • Caveats apply to specific occupations relating to the work experience, salary, business turnover, location (regional), and the type of business.
  • Businesses must pay the visa holder the going Australian market rate for their salary, which must meet the Temporary Skilled Migration Income Threshold requirements. Therefore, the market rate is classified as equivalent to what an Australian citizen or permanent resident would be paid.
• The business looking to sponsor a worker must undertake labour market testing to show that there are no Australians with the skill level required or desire to fill the position. Labour market testing is compulsory (unless an international commitment applies) and must be launched within 4 months of a nomination being lodged. It requires at least 3 advertisements to be posted:
  
  • It is mandatory to have one on the required government workforce australia website, but must be undertaken by following specific requirements.
• The business nominating a worker will be required to contribute to the Skilling Australians Fund (SAF), the amount of which is determined by the annual turnover of the business and is payable when the worker is nominated.
  
  • $1200 per year for small businesses with a turnover of less than $10 million
  • $1800 per year for businesses with a turnover of over $10 million.

Step 3: Visa

• The visa applicant is required to have at least 2 years of full-time work experience post-qualification in the occupation they are being nominated for. Evidence must be submitted showing sufficient skills and experience in a similar role through training or recognised qualifications
• The visa applicant must meet English-speaking requirements if they come from a country where the first language is not English
