From the 14 February 2014, one of the first of many 457 legislation upcoming changes were implemented. Previously all standard business sponsors approval was subject to nomination ceiling. This meant that if the SBS was approved the number of nominations that the employer could sponsor was included in that approval. Therefore if the employer reached this ceiling before the expiry of their standard business sponsorship (3 years), they would not be allowed to nominate any more candidates unless they re-applied for a sponsorship application.
Post 14 February 2014, employers who wish to apply for sponsorship must still indicate a reasonable amount of nominations they intend to make within their 3 year sponsorship validity, and a decision to grant the sponsorship will take into account their ‘reasonable’ number of nominations they request.
