Department targets illegitimate ‘genuine positions’

When applying for the popular 457 visa allowing you to live and work in Australia, you need to be able to approve that the job you will be doing is in fact a ‘genuine position.’ As defined by the Department of Immigration a genuine position is a job that has been advertised in Australia and not filled by an Australian worker.

Due to several incidents of Australian employers creating jobs specifically for an individual who is applying for a visa, the Department has cracked down on several industries and professions ensuring the job is a ‘genuine position.’

These jobs are positions such as:

  • Customer service managers
  • Hospitality staff
  • Position in a family business
  • Marketing specialists

If there is an indication that the role may not be a genuine position, the Department will not only investigate the applicant but the employer also.  An audit will be conducted on the business assessing things such as:

  • The number of staff
  • Size of the business
  • Responsibilities and tasks of the applicant
  • Company structure

To protect the integrity of the skilled visas in Australia, it is important these measures are put in place to ensure that any available employment opportunity in Australia goes to the most deserving and qualified candidate.
