Case Study 1 - Employer Sponsored Visas

A corporate client of ours who ran a retail operation in a regional area shopping centre had applied to the Department of Home Affairs to sponsor an employee under an occupation that matched the employee’s skills set. The occupation was as electronics equipment trade worker. The application was refused because the delegate reasoned that the role was based in one location and the tasks and duties of that occupation are meant to have field visit repairs as a key feature.

The Company then contacted us to assist. We understood the delegate’s point of view and understood the company’s need for the position being essential for their business. They had previously been advised by other agencies that the applicant should change his occupation to fit another occupation. We disagreed for the following reasons:
  1. The appeal application they had previously lodged would be an issue as it was based on the original occupation in the first refusal.
  2. This would cause compounding issues in affecting the already lodged appeal plus it would affect the applicant as a different occupation would conflict with his skills set and would set them back to square one.
 

Our Solution

After thorough research into the business activities, their client base, and operations we advised them to:
  • Expand their business scope to clients and advertise these new offerings
  • Conduct a business feasibility review into expanding their scope of services to include field visits
Adopting this suggestion would open opportunities for the company to generate more business and could allow the applicant’s tasks to include the key features missing from his initial job description. This was not a hard task for the Company owner to implement.

Outcome

The problem was solved, and we were able to demonstrate that all criteria was satisfied with a new successful application and visa outcome.
